Our client came to us last spring with an IRS tax problem covering tax years 2008 and 2009. The tax liability stemmed from two joint returns filed with her now ex-spouse. She came to us not knowing what to do or whom to turn to regarding the IRS claim. We began work right away.
Fortunately, the taxpayer had all divorce documentation as well as documentation showing mental, emotional, and some physical abuse by the ex-spouse. Unfortunately, her and her children had been abused in the past as well. When we found this out we knew we had a case. Essentially she was forced under duress to sign the tax return. She was not aware of the tax liability. She was fearful if she didn’t sign the return she would be apprehended. She simply signed each return to make sure her husband was happy with her efforts. We started gathered all of the documentation necessary to prove her case.
Once we gathered all of the documentation, we drafted the innocent spouse form and sent everything into the IRS. Low and behold we checked her accounts yesterday and the IRS had already adjusted the account balances for 2008 and 2009 to zero. We are still waiting on the adjustments and the final acceptance letter to roll through.
